MARAGA WARNS POLITICAL PARTIES AGAINST MALICE AS MWILU SWORN INTO JSC

Deputy CJ Philomena Mwilu was sworn in on Tuesday to replace Justice Smoking Wanjala at the JSC.
She was elected on May 3 to serve a five-year term as Wanjala's tenure ended last year. Mwilu, who doubles as the Vice President of the Supreme Court, was appointed as a member of the JSC by President Uhuru Kenyatta on May 12 upon her unanimous election by a seven-member bench.

Chief Justice David Maraga, who presided over the ceremony as JSC chair, expressed confidence that the DCJ will help steer the Judiciary to greater heights.

Mwilu promised to work closely with her Supreme Court colleagues and the 10-member JSC.

Maraga warned politicians against issuing inflammatory and reckless statements during campaigns for the election in August.

He said the "independent and impartial" Judiciary will not entertain manipulation, control or influence from any quarters.

The Chief Justice noted officers and staff have been adequately trained to handle disputes but warned he does not expect malicious propaganda from parties aggrieved by decisions of the Political Parties Disputes Tribunal, the High Court and the Court of Appeal.

Maraga said magistrates and judges only relied on facts and the law while hearing and determining the cases. He said it will be futile for disgruntled elements to claim judicial officers were being directed on how to handle their constitutional mandate.

"I will not respond to reckless statements from politicians during the campaign period. I want Kenyans to have confidence in the Judiciary," he said.

The CJ said the seven-member Political Parties Disputes Tribunal had concluded the majority of 250 petitions filed by candidates who complained of malpractices during the nominations. Thirty two appeals are pending adjudication by the High Court.

Maraga also said he had sanctioned the tribunal, chaired by veteran lawyer Kyalo Mbobu, to work overtime and during weekends to clear the huge number of petitions filed from across the country at the Milimani law courts in Nairobi
