UGANDAN PARLIAMENT ORDERS IMMEDIATE RELEASE OF DETAINED CHILDREN
UGANDA: Parliament has Tuesday ordered for the immediate release of three children who were arrested on March 19 2017, two days after the assassination of AIGP Felix Kaweesi alongside his bodyguard Kenneth Erau and driver Godfrey Wambewa.
Police on Thursday released 12 of the 15 minors who are said to be children of Abdul Rashid Mbazira and Higenyi Ramathan, suspects in the murder of AIGP Kaweesi.
The Speaker was perturbed that police resorted to abducting innocent children who by law can’t commit any crime.
“I want to remind the Minister of Internal Affairs that it is a cardinal principle of law that children below the age of 12 have no legal capacity to commit an offence; we expect a statement and I hope this can be addressed,” noted Kadaga while communicating to the house on Tuesday.
Kadaga said according to Sec. 244 of the Penal Code, “Any person who kidnaps or abducts any person with intent to cause that person to be confined commits a felony and is liable to imprisonment for 10 years”.
Kampala Woman Member of Parliament (WMP), Nabilah Nagayi Ssempala informed that house that during the weekend, she met with the mother of the three children (from Ishaka) who are still under detention who told her that she tried her level best to rescue her children but unsuccessfully.
“The three children who were picked from Ishaka are still languishing in police cells, their mother was told that a DNA test was to be carried out first before returning the children; this she did and after a week, it was confirmed that she is the mother but told that another DNA must be carried out on the father,” Nabilah narrated.
The State Minister for Internal Affairs, Mario Obiga Kania told members that the Police Standards Protection Unit is handling the issue of returning the children to their homes but are still stuck with identifying their parents.
“The Police Standards Protection Unit right now as am talking has taken custody of all these children with the purpose of returning them to the parents, some of them have been returned, those others that have not been returned is an issue of identification of their parents,” Obiga said.
This explaination didn’t go well with members which prompted the Speaker to order that the abducted children are returned to their families immediately and the abductors produced before open Courts of Law by today.
